How Much Jail Time Can Someone Get for Possession of Marijuana?

The amount of jail time a person could face for possession of marijuana or weed is wholly dependent on the amount alleged to have been possessed. If a person has a user amount, or in Nebraska what we would consider to be less than one ounce of marijuana, for a first offense you cannot face any jail time.

If you possess more than one ounce but less than one pound of marijuana you could face up to 90 days in jail and up to a $500.00 fine. If the amount alleged to have been possessed is more than one pound of marijuana then that is considered to be a Class 4 felony. You would face up to 2 years in prison and up to a $10,000.00 fine.

If the allegations are that you were in possession of more than a user amount, in other words, an amount that would include some sort of indication of an intent to distribute the marijuana, then you would face up to 20 years in prison and up to a $25,000.00 fine.
