If you’re operating a motor vehicle without a driver’s license in Nebraska and a traffic stop is conducted on you, this in and of itself gives the officer the legal grounds to detain you. This would allow the officer to bypass any requirement of reasonable suspicion to detain you beyond the scope of the traffic stop as he has clear evidence that you are committing a violation of the rules of the road.
This does not necessarily mean that you would be booked into a county jail for a violation of operating a motor vehicle without a license, but you could be issued a citation. Because you don’t have a valid license, it is very unlikely that the officer would allow you to drive the vehicle away from the scene. If no one else was present who could operate the motor vehicle lawfully, the vehicle would either be parked on the side of the road until a lawful driver could come get it or it would be towed to a local impound lot.
If a person is caught operating a motor vehicle without a license and then subject to arrest that particular offense, then an officer could conduct a search of the vehicle incident to that arrest. If the car were towed to an impound lot, then it’s very likely that the impound lot would conduct what is called an inventory search of the vehicle to determine what personal belongings were in the vehicle.
